Freedom of movement is being called into question by recent bans on leaving the country. MP Guy Marius Sagna has spoken out: "In a state governed by the rule of law, any restriction of fundamental rights must be transparent and predictable." He points to practices that violate Article 12 of Law No. 2021-21 of March 2, 2021, which requires prior notification of any individual administrative act, a principle flouted in several recent cases.
Faced with these abuses, Guy Marius Sagna announced that he intends to question the Minister of Justice on four specific points: “Are investigations or judicial inquiries targeting former public officials subject to these bans? Were these people informed in advance, before being blocked at the airport? Does a clear legal framework govern these administrative bans? Is the government planning reforms to guarantee legality and prior notification?”
These questions, he emphasizes, seek to restore transparency and protect citizens' fundamental rights. The case takes on particular resonance with the case of former minister Mansour Faye, who was recently banned from leaving the country without an official explanation, fueling concerns about the arbitrariness of these measures.
