Affaire Pape Malick Ndour : Me El Hadj Diouf dénonce une « violation flagrante de ses droits »
Former Youth Minister Pape Malick Ndour was released from his hearing at the Colobane Research Section. His lawyer, El Hadj Diouf, accompanied by Mr. El Hadj Oumar Youm, strongly denounced what he described as political harassment and a violation of his client's rights.
Visibly angry, Mr. Diouf pointed out the conditions under which the former minister was summoned and questioned. "All of Pape Malick Ndour's rights were violated. He has absolutely nothing to reproach himself for. He did not give orders to kill, he did not speak to thugs, he is not a criminal, he is not a murderer," Mr. Diouf insisted to the press.
The lawyer revealed that the hearing proceeded quickly because, according to him, the investigators had no evidence to accuse the former minister of anything. "The investigators didn't take long. It happened very quickly because there was nothing, absolutely nothing to accuse him of," he said.
Lawyer El Hadj Diouf also protested against the procedure itself, arguing that a minister should not be summoned in this manner. "As a minister, he should never have been summoned here. This is the first violation of his rights. A minister benefits from a special jurisdiction. Only the High Court of Justice can try a minister," he argued.
This summons was more a deliberate attempt to humiliate his client than a genuine legal action, he continued. "They tried to humiliate him. They're losing their minds because of animosity, the desire to hurt someone who has always been concerned about the development of his country," he insisted.
“Hardship” against APR executives
The lawyer expanded his remarks by denouncing what he considers to be a systematic persecution of the Alliance for the Republic (APR) officials capable of challenging the current government. "This great economist is keeping them awake at night. He is a high-level, courageous man who challenges issues that this government does not understand. He is disturbing, like all the APR officials who are capable of challenging a panicked government," declared Mr. Diouf.
According to him, it is the government's "incompetence" "in the face of floods, the high cost of living, the lack of employment for young people and their broken promises" that motivates these summonses. "These APR officials always bring contradiction with concrete elements on the table. We are trying to muzzle them," he added.
Maitre Diouf revealed that his client was summoned based on a simple complaint, without any tangible evidence being provided. "I asked the investigators: where is the evidence? No evidence. The gendarmes have shown that they are incapable of producing the slightest proof. We came out of the investigation feeling refreshed. Nothing, nothing, no evidence," he insisted. Before asserting that Pape Abdoulaye Touré's complaint, which allegedly prompted the summons, was dismissed. To the gendarmes, Pape Malick Ndour categorically denied any involvement in the violence he is accused of.
"He can travel tonight."
The logical consequence of this lack of charges, according to Mr. Diouf, is that his client is completely free to move around. "Therefore, we will return. He can travel tonight," concluded the lawyer, thus indicating that Pape Malick Ndour is not subject to any restrictive measures.

Un ministre passe devant la HCJ pour des faits relevant de sa fonction. Le reste c’est comme simple citoyen. Des avocats spécialisés en politique.
L'avocat le plus nul de l'union des bareaux du monde. Pour être attrait devant la Haute Cour de Justice il faut qu'il y ait un lien de connexion entre les faits reproches et la fonction. Recruter des nervis n'est et ne peut être assimilé à un acte de gestion d'un ministre par conséquent un affaire qui en relèverait est justiciable devant le tribunal correctionnel
Pape Malick Ndour est plus jeune mais plus intelligent, plus d'expérience et plus pertinent que Sonko et Diomaye réunis.
Un jeune qui les malmène avec des arguments solides.
Lors de la présentation d'excuses de la famille de Ahmed Suzanne Camara à Diomaye et Sonko, ils avaient laissé passer certaines informations. La famille avait regretté que Ahmed Suzanne soit abandonné à son sort par l'APR. Mais pire, la famille a dit être allé rencontrer Me Elhadj Diouf pour négocier qu'il prenne en charge sa défense. Me Diouf leur avait répondu que lui il ne veut plus avoir à s'immiscer dans les affaires des gens de l'APR parce que ce sont des gens qui ne tiennent pas parole, il en veut pour preuve leurs engagements pour qu'il assure la défense de Bah Diakhaté. Mais en fin de compte ils n'ont pas tenu parole. Que s'est il passé pour qu'il reprenne leur défense ? Ils ont allongé le blé ?
