Senegalese businessman Bocar Samba Dièye has just won another legal victory against the Swiss company Ascot Commodities. According to Libération, which broke the story, this development further weakens the multinational's claims regarding old debts dating back to 2004. These debts, which Dièye has always described as "fictitious," are being addressed by the businessman, who maintains that he paid all the rice invoices through an escrow account opened at BICIS.
Based on an arbitration award issued in Paris last February, Ascot had initiated enforcement proceedings in Senegal. These proceedings resulted, on November 14th, in the seizure of receivables amounting to more than 7 billion CFA francs against Bocar Samba Dièye, the newspaper recounts.
However, the same source indicates that in a ruling issued on December 22, the Dakar court overturned the order that served as the legal basis for these seizures. This is a serious setback for the Swiss company, especially since the Senegalese courts had already established, in a previous case, that the situation was reversed: Ascot actually owes 800 million to Bocar Samba Dièye.
The battle continues before the Commercial Court
With this cancellation confirmed by Libération, the economic operator is now pursuing its action before the Commercial Court in order to obtain the definitive release of the seizures.
