Cour suprême : pourquoi Ousmane Diagne n’a toujours pas réintégré son poste
Replaced last September by Yassine Fall during the cabinet reshuffle, former Minister of Justice Ousmane Diagne has still not been reinstated to the Supreme Court. Yet, according to established procedures, he should have automatically been reinstated.
According to Les Échos, this situation is explained by a legal problem: the act which allowed his assignment to the Public Prosecutor's Office of the high court has become invalid, making a new act of appointment necessary.
However, according to the same source, such a decision falls under the purview of the High Council of the Judiciary (CSM), which has not met since June 26, although it is supposed to hold at least two sessions per year.
Why has there been no meeting of the High Council of the Judiciary (CSM) yet to reinstate him to his post? The newspaper questions the reasons for this delay: is the former minister suffering the consequences of his refusal (and that of his team) to comply with a request for a retrial while he was in office?
Meanwhile, time is working against Ousmane Diagne: if he is not reinstated at the Supreme Court before his imminent retirement, he risks losing the three years of service to which he could still claim following the extension of the retirement age granted to magistrates of this rank, Les Échos points out.
