Death of a newborn at Diourbel hospital: The midwife on duty convicted but free

The Diourbel High Court delivered its verdict this Thursday, December 4, 2025, in the case of the death of a newborn at the Heinrich Lübke Regional Hospital. The midwife on duty at the time of the incident was found guilty and sentenced to three months' imprisonment, suspended.

The defendant, Fatou Diarra, will have to pay a fine of 500,000 CFA francs to the public treasury.

She will also have to pay the sum of one million CFA francs to the mother of the newborn as damages, according to Seneweb sources.

As a reminder, the midwife in question, who was remanded in custody, was tried on Thursday, November 27, 2025 for failing to assist a person in danger and endangering the lives of others, following the death of a newborn baby last October.

In his closing arguments, the prosecutor had asked the court to sentence the midwife to two years in prison. Of those two years, the prosecution had requested that one year be served in prison.

For his part, Serigne Diongue, one of F. Diarra's lawyers, had argued for acquittal on the charge of endangering the lives of others. Regarding the charge of failing to assist a person in danger, he had asked the judge for leniency.

The tragedy dates back to the night of Friday, October 17, 2025. Between 9:00 p.m. and 10:30 p.m., a pregnant woman arrived at the Heinrich Lübke Hospital in Diourbel. She was in obstetric emergency and her delivery was imminent.

However, the maternity ward staff reportedly refused to admit her. The reason given was a lack of available beds in the facility. The patient was then sent home.

Faced with this dramatic situation, the woman ended up giving birth in front of the hospital's entrance. The newborn died as a result of this lack of medical care.
