Diffamation : Le ministre Moussa Bala Fofana revient à la charge contre Djidiack Faye
The Minister of Urban Planning, Moussa Bala Fofana, is not giving up on his case against Djidiack Faye, director of the Fatick Regional Development Agency (ARD), and the newspaper "En=Relief." While the criminal court declared the proceedings null and void on September 24, 2025, the minister is back on the offensive. His lawyer, Alioune Badara Ndiaye, has relaunched the direct summons. The case was heard on November 12, 2025, at the Dakar court, but the trial was postponed until the 26th of this month.
The minister is demanding 500 million CFA francs in damages and interest.
In his latest statement, Mr. Ndiaye asked the court to convict Djidiack Faye and journalist Cheikh Seck Ndong, editor of the newspaper En=Relief, following the prosecution's recommendations, and to issue a warrant for their detention or arrest. The lawyer also requested that the defendants be jointly and severally ordered to pay the plaintiff 500 million CFA francs in compensation for moral and material damages suffered. He further requested that the newspaper be held civilly liable for the financial penalties imposed on its employee and suspended for one year.
At the hearing on June 11, 2025, Djidiack Faye's lawyer, Abdoulahi Diallo, raised an objection of nullity, arguing that the summons did not comply with the time limits set by Article 625 of the Code of Civil Procedure. The public prosecutor then deferred to the court's judgment.
For his part, Me Alioune Badara Ndiaye had argued for the rejection of this exception, considering the request unfounded and maintaining that the summons had been made in accordance with the rules, by separate acts.
Originally scheduled for June 25, the verdict had been extended to September 24, 2025. In its decision, the court declared the proceedings concerning Djidiack Faye null and void, but ordered the prosecution against journalist Cheikh Seck Ndong.
The Minister of Urban Planning is suing those accused of defamation, spreading false news, and complicity. The dispute stems from an article published under the title "En=Relief," signed by Djidiack Faye, in which he accused Moussa Bala Fofana of orchestrating a conspiracy surrounding the recruitment process for the director of the Municipal Development Agency (ADM).
