« Le Sénégal joue avec le feu » (magistrat à la retraite)
In a critical analysis of the accountability policy pursued by the new regime, published by L'Observateur, the former president of the Kaolack Court of Appeal, Ousmane Kane, warns against repeating past miscarriages of justice. A retired magistrate, he compares the approaches adopted under Presidents Abdou Diouf, Abdoulaye Wade, and Macky Sall, before concluding bluntly that "Senegal is playing with fire."
According to Ousmane Kane, the Senegalese justice system is already suffering from a credibility crisis internationally. He cites in particular the Doro Gaye case, in which a French judge refused to execute a Senegalese arrest warrant on the grounds that the guarantees of a fair and equitable trial were not met.
This mistrust, he recalls, had already been manifested during the Karim Wade and Bibo Bourgi case before the CREI, which earned Senegal a condemnation from the UN Human Rights Council for arbitrary detention, as well as a financial sanction of nearly 200 billion CFA francs by UNCITRAL for denial of justice.
Ousmane Kane said he was surprised to see that the country now seems to be taking the same path as the CREI, particularly through the procedures carried out by the High Court of Justice and the Financial Judicial Pool (Pjf).
He denounces the systematic referral of cases to investigating judges based on CENTIF reports, without any preliminary investigation or opportunity for the individuals concerned to justify themselves beforehand. This method, according to him, leads to arrests and detentions deemed brutal and contrary to international conventions. The former magistrate cites in particular the case of Mbagnick Diop, believing that a preliminary investigation would have prevented procedural excesses.
He also points out the lightness of the charges in certain cases handled by the High Court of Justice, such as those involving Mansour Faye and Sophie Gladima.
The former judge warns that these flaws risk leading to fragile trials and resounding failures, which will only weaken justice and discredit the accountability process.
For him, the fight against corruption is a noble ambition, but it is compromised by rushed prosecutions carried out without strict adherence to the rule of law. He warns that Senegal once again runs the risk of being heavily condemned internationally. "This is too high a price to pay for a country seeking both to stabilize its economy and restore confidence in its justice system," he concludes.

Le détournement de deniers publics est l’infraction la plus gave la plus malhonnête.
Regarder l’ancien président français il va aller en prison pour beaucoup moins que ce qui est reproché a ces anciens ministres ou autre et ce magistrat s’inquiète de quoi ?

Une chose semble sure, si Mansour Faye et Sophie Gladima étaient devant ce juge quand il était en fonction ils auraient été contents.
Il n’y avait pas une histoire de Ngogne avec ce magistrat ?

On est loin du temps où on emprisonnait des gens pour éliminer des opposants politiques. Et bizarrement on t'a jamais entendu. T'es qu'un lâche sûrement un néo politicien.
L'autre chose, est de vous intéresser aux personnes qui sont à la CENTIF. Sont-elles au dessus de tout soupçon d'impartialité?

A vrai dire, c'est sous le règne de Macky Sall que nous avons tout vu avec la justice. C'était une justice colorée foncièrement, une justice "empoignée", une justice asservie avec des magistrats exécuteurs d'ordre de toute sorte. Alors, je voudrais qu'il me dise, ce Monsieur Kane, où était-il en ce moment ?
Je pense qu'il ne faut pas imputer tout ceci aux politiques!

Pourquoi il n'a jamais dénoncé cette loi quand il était magistrat
N'est ce pas il est allé rendre visite Azoura Fall en prison et demander à ses avocats de mentir qu'il est un malade mental pour le sortir de prison.

Au Sénégal un simple rapport de la Centif qui du reste ne rassemble que des soupçons suffit.
N'oublions pas qu'à l'origine du Centif c'était des directives internationales pour lutter contre le terrorisme suite aux attentats du 11 septembre.
