Mame Mbaye Niang contre Ousmane Sonko : le duel se déplace sur le terrain immobilier
The case between Prime Minister Ousmane Sonko and former minister Mame Mbaye Niang has taken a new legal turn. The case, which opened for a hearing on Monday, February 2nd, at the Dakar High Court, has been adjourned to February 11th before the 3rd Civil Chamber, reports L'Observateur.
An accusation of fraudulently concealing real estate
The same source explains that this procedure stems from the final conviction of the Pastef leader for defamation in 2023. In addition to a two-month suspended prison sentence, he was ordered to pay 200 million CFA francs in damages to the former minister of Macky Sall.
Reported by the daily newspaper of the Future Media Group (GFM), the lawyers for the plaintiff accuse the Prime Minister of having orchestrated his insolvency in order to avoid paying this debt. They are specifically contesting the transfer of the leasehold rights to a 264 m² plot of land, lot R/17, located in the Keur Gorgui district. According to the plaintiffs, Ousmane Sonko "knowingly impoverished himself" by transferring this property, in violation of Article 200 of the Code of Civil and Commercial Obligations.
This legal action is presented as a response from Mame Mbaye Niang's lawyers to the attempts to revise the initial trial (PRODAC case), mentioned by the current Minister of Justice, Yassine Fall.
During the allocation hearing, L'Observateur notes, the judge referred the case to the 3rd Civil Chamber, in order to allow both parties to file their written submissions and produce the documents on which they base their claims.
Despite previous Supreme Court decisions that closed the criminal case, the legal battle between the two men is now continuing in the civil arena, adds the Gfm headline.
