Révision constitutionnelle : Les secrets du texte validé en Commission des lois
Draft law No. 17/2026, concerning the revision of the Constitution, has reached a crucial new stage. After thorough review, the text was amended several times by members of parliament and the government before being adopted by a majority vote in the Committee on Laws, Decentralization, Labor, and Human Rights. The draft is now submitted to the full parliament for a final vote in plenary session this Monday at the National Assembly.
The committee work resulted in several major amendments, notably concerning the functioning of institutions, the prerogatives of the President of the Republic and the Prime Minister, the role of the future Constitutional Court, asset declarations, and the mechanisms for the accountability of the Head of State. Among the major changes adopted are the introduction of a new Article 101, which specifies the conditions for impeaching the President of the Republic for high treason before the High Court of Justice; the reformulation of Article 42 to reaffirm that the President ensures respect for the Constitution; and new provisions relating to transparency, good governance, and the proper functioning of institutions.
Editorial adjustments and a new institutional formulation
During the debates, the commissioners also proposed adjustments to several articles of the text, notably articles 17, 29, 57, 59, 61, 80, 89, and 92, in order to improve their consistency and legal certainty. On a more symbolic note, they also suggested enshrining the title "Honourable Member" in the fundamental charter.
Following the discussions, the authors of the bill accepted several observations made by the members of parliament, considering that these amendments strengthen the coherence of the bill without altering its overall balance. The Commission's report concludes that the amendments, presented by both the members of parliament and the government representative, enrich the text. The commissioners therefore adopted the bill by a majority vote and urge all members of parliament to do the same in the final vote.
Attention is now focused on the chamber this Monday, where members of parliament will have to make a final decision on this important constitutional reform, which is set to reshape several major institutional balances in Senegal.
