Thiès : Un courtier risque 6 mois de prison ferme pour la vente illicite du terrain d'autrui
The Thiès court of summary jurisdiction examined a real estate fraud case involving broker I. Thioye on Friday, December 19. He is being prosecuted for selling a plot of land, actually belonging to Mr. Coly, to a third party, Mr. Sankaré.
The affair began when Mr. Sankaré, wishing to acquire a plot of land for residential use, sought the services of the broker. I. Thioye then offered him a plot of land located in Thiès for 4,500,000 FCFA. Once the transaction was completed, the buyer received a sales certificate allowing him to begin the administrative procedures for obtaining a lease.
However, Mr. Sankaré's plans were abruptly halted. While he had already begun construction, the Directorate of Land Use Monitoring and Control (DSCOS) intervened, ordering the immediate cessation of work due to a land dispute. Faced with this situation, Mr. Sankaré attempted to contact the broker, but he had become completely unreachable. The buyer then filed a complaint for fraud, leading to the arrest and detention of I. Thioye.
During Friday's hearing, the defendant admitted to the charges against him. In his defense, he claimed to have acted on behalf of a cooperative headed by a Mr. Kaïré. I. Thioye maintained that he had paid the entire sum to Mr. Kaïré, retaining only a commission of 300,000 FCFA for his role as intermediary.
For its part, the plaintiff maintained its claims, demanding full reimbursement of the 4,500,000 FCFA paid during the fraudulent transaction.
The public prosecutor expressed doubts about the actual existence of the cooperative mentioned by the defendant. According to the prosecution, I. Thioye bears full responsibility since he is the sole signatory of the sales certificate given to the victim. Consequently, the prosecutor requested a two-year prison sentence, with six months to be served.
The court has taken the case under advisement and will deliver its judgment soon to determine the broker's guilt.
