Daba Mbodji, alias Gaïdé Macky, 46, a shopkeeper living in the Fadia estate, appeared before the Dakar flagrante delicto court this Wednesday. She is being prosecuted for the offenses of insulting a person exercising a function that is part of the prerogatives of the President of the Republic, in this case Ousmane Sonko, making speeches contrary to public decency, and insulting a group (Pastef activists) via computer.
In a live stream on TikTok, Daba Mbodji made offensive remarks against Pastef party leader Ousmane Sonko.
The defendant appeared in court on crutches with a fractured right leg. However, at her first appearance, she was in good health.
However, following a screening of the incriminating audios, the defendant stood by her statements. She explained herself, saying that Pastef activists had revealed on the internet her audios and intimate images that she had sent to her boyfriend. "With whom I lived for 3 years. It's true that I'm the one dancing in the video. But he sold it to Pastef activists. Worse, some created a montage with nudity, claiming that it was her."
She added that a friend invited her to a live stream on TikTok to explain the incident, but a Pastef activist insulted her and its leader, Macky Sall. She responded by insulting their leader.
The prosecutor asked him who the leader of the Pastef party is, to which Daba Mbodji replied:
"I didn't mention any names."
In his observations, the public prosecutor requested acquittal for the offense of insulting a group via computer. However, the prosecutor requested that she be found guilty for the other two offenses. The prosecution requested a six-month prison sentence.
The defense, led by Oumar Youm and El Hadji Amadou Sall, who dispute the offense, requested a suspended sentence. The case is adjourned until October 20.

Le procureur de Sonko, n'a pas le droit de s'amuser avec la liberté des citoyens sénégalais.
