TGI de Mbour : Deux cousins relaxés dans une affaire de 1 400 euros de faux billets

BC, who was passing through Senegal, was tried alongside his cousin BD at the Mbour High Court's flagrante delicto hearing in a case of possession of counterfeit banknotes.

According to the facts, BC, living in France, came to spend some time in Senegal. As he did on each of his visits, he contacted his cousin BD to find him an apartment in Saly. Before boarding, he had received the sum of 1,400 euros in France, from the repayment of a debt by a friend. But once he arrived in Senegal, he began to doubt the authenticity of the banknotes and spoke to his cousin about it. Together, they decided to go to a currency exchange agency to check the validity of the bills. It was then that they were arrested, following a tip-off.

In court, BC argued that he was unaware that the euros were counterfeit and that he was simply trying to verify their authenticity. His lawyer, Abdoulaye Tall, argued that his clients acted in good faith. "There was no agreement between them. There was no intentional element," the lawyer said, pointing out that such a situation could happen to anyone.

To illustrate his point, Mr. Tall recalled a personal experience: "Once, when I was paying for my child's school fees, the accounting department informed me that one of the bills I had presented was counterfeit."

BC and his cousin BD were acquitted, benefiting from the doubt regarding their guilty intent.
