Thiès : Deux frères devant le tribunal pour outrage à un gendarme lors de l’interpellation de leur neveu

Mr. DN and Mr. SC were sent to prison after being arrested for assaulting a gendarme on duty. The latter had gone to their home to arrest their nephew, IS.

Mr. DN intervened, asking the gendarme why he was there before ordering him to "get out." When the gendarme grabbed his nephew, DN tried to free him, provoking an altercation between the two men. DN then grabbed the gendarme in turn. His brother, SC, intervened to get involved, making the situation worse.

Faced with this resistance, the gendarme called for reinforcements, which led to the arrest of DN and SC for insulting an officer.

The sleuths then arrested the nephew, IS, who was found in possession of Indian hemp. When questioned about the origin of the drugs, he named an elderly man named IC before leading the police to his home. A search of the premises revealed a bag containing 1.2 kg of Indian hemp in the latter's bedroom.

Prosecuted respectively for contempt of an officer, use of Indian hemp and transfer or offer of Indian hemp, DN, SC, IS and IC were all placed in custody.

At the Thiès flagrante delicto court, DN admitted to grabbing the gendarme, while specifying that the latter was in civilian clothes and had not identified himself. His brother, SC, claimed to have intervened to separate them.

As for their nephew, IS, he admitted to having a cone of Indian hemp intended for his own consumption.

For his part, the old IC contested the quantity seized, maintaining that the gendarmes had only found 100 grams, and not 1.2 kilos of hemp.

Considering the facts to be consistent, the public prosecutor requested the application of the law.
