W. Kama, nicknamed Amy, a 26-year-old housekeeper living in the Ouagou Niayes housing project, faces a 10-year prison sentence. She is accused of rape, pedophilia, unnatural acts, corruption of a minor, and facilitating access to pornography for Nd. Kh. Ndiaye, a 9-year-old girl, the daughter of her employer. This disturbing case was tried this Tuesday before the Criminal Court of Dakar.
On January 14, 2022, Mr. Diene, a seamstress and the victim's mother, contacted the Dakar Urban Security Service to report the alleged abuse committed by her housekeeper. According to her, Amy not only sexually abused her daughter, but also made her watch pornographic films. An investigation was opened by the vice squad.
It all began on January 12, 2022, when Mr. Diene was summoned by Messrs. Sylla, a supervisor at the Daroul Imane Institute in Sicap Mbao, where Nd. Kh. Ndiaye had been attending school since October 2020. The supervisor reported that the girl had confided that she had been the victim of sexual abuse by Amy, who had been employed at the family home since 2018. Questioned by her mother, Nd. Kh. Ndiaye confirmed these allegations. She said that the cleaning lady made her watch pornographic videos, telling her: "That's what mom and dad do at night in their room." She also accused Amy of inserting a finger into her private parts and asking her to suck her breasts.
The girl adds that when her mother was at work, Amy would invite a man into her home for sex in their shared bedroom. According to her, the man once gave her 15,000 CFA francs after abusing her, a sum she then gave to Amy on his orders. She claims the housekeeper taught her sexual practices, forced her to watch explicit videos, and administered mystical baths, threatening to kill her if she spoke out.
Mr. Diene corroborates some of the evidence, noting a change in his daughter's behavior since Amy's arrival. Previously going to bed at 8 p.m., Nd. Kh. Ndiaye was staying up late. The father, Moussa Diop, confirms that his daughter and Amy shared the same bed and that he had repeatedly caught them whispering at odd hours. During one test, investigators gave the girl a phone, which spontaneously typed "porn," bringing up explicit content. She explained that she learned how to do these searches thanks to Amy.
A medical examination at the Dakar Institute of Hygiene and Social Sciences, conducted on January 17, 2022, revealed a gaping hymen, minimal stool loss, and behavioral disturbances in the victim. Initially, Nd. Kh. Ndiaye refused the examination, crying and fearing the doctor would hurt her, but a police officer managed to reassure her that it would be performed the next day.
When questioned, W. Kama initially denied everything, calling the girl a liar. Pressed by investigators, she eventually admitted that she watched pornographic videos in their shared bedroom, while minimizing her involvement. In court, she maintained her innocence, rejecting all accusations. She maintains that the videos found on her phone were sent to her by a colleague and that she didn't have time to watch them, busy cooking. According to her, her boss is trying to get rid of her by falsely accusing her.
The civil party, absent from the hearing, was represented by Mr. Alioune Badara Fall, who claimed a symbolic franc in damages. The prosecutor requested acquittal on the rape charge based on the benefit of the doubt, but requested guilt on the other charges, proposing 10 years of criminal imprisonment after concurrent sentences. The defense, represented by Mr. Ousmane Diallo, pleaded for a total acquittal, denouncing a selective analysis by the prosecution and suggesting that the victim had an overactive imagination. The verdict is expected on April 15, 2025.
