South Africa: Court allows men to take their wives' names

Afrique du Sud: la justice autorise les hommes à prendre le nom de leur épouse

In South Africa, men can take their wife's surname, the Constitutional Court ruled Thursday, ruling a law that prohibited it to be discriminatory.

In its ruling, it found that the ban "reinforces patriarchal gender norms, which prescribe how women can express their identity."

The case was brought to court by two couples. One wanted to honor the memory of the bride-to-be's parents, who died when she was young. In the other case, the woman wanted to maintain her ties to her family name because she was an only child.

Previously, men had to apply to the Home Office for permission to change their surname, a request that was not automatically granted.

Provisions allowing men to take their wife's surname upon marriage are already in force in most European countries and some American states.
