Mandats et nominations des membres à l’Ofnac : Les réserves des députés sur l’appel à candidatures
At the intercommittee meeting, parliamentarians expressed their concerns about the length of mandates and the appointment procedure for members of the National Office for the Fight against Fraud and Corruption (OFNAC).
"The deputies discussed the modalities of governance and appointment of OFNAC members. Indeed, while the bill retains the principle of a call for applications followed by appointment by decree, some Commissioners felt that it was appropriate to reconcile this requirement for transparency with the need to give the Head of State room for maneuver in the choice of members of the Office. With this in mind, it was recommended that at the end of the selection process, a shortlist of three candidates for the presidency of OFNAC be forwarded to the President of the Republic," reported their comrade Youngare Dione.
Better still, they expressed reservations about limiting the mandate of half of the first members of the Office to three years, since they will be appointed at the same time.
Responding to the appeal by elected representatives, the Minister of Justice argued that while the call for applications procedure demonstrates a transparent approach, the power of appointment remains discretionary and belongs to the President of the Republic, in accordance with his constitutional prerogatives. "Consequently, he cannot be bound by choices that appear dubious to him," Ousmane Diagne retorted.
Bill No. 12/2025 establishing the National Office for the Fight against Corruption, which was examined by the deputies meeting in plenary session this Monday, August 25, 2025, at the National Assembly, is currently being examined at the National Assembly.

Chers honorables députés,
Vous êtes les représentants du peuple, et à ce titre, vous avez une responsabilité historique. Or, il est manifeste que la majorité populaire ne soutient pas le principe d’un appel à candidatures pour la nomination des membres de l’OFNAC. Ce projet, bien qu’animé par une volonté de transparence, risque de créer une fracture entre les institutions et ceux qui leur donnent leur légitimité : les citoyens.
Quand un président est élu, il vient avec une vision, une équipe, des femmes et des hommes qui incarnent son projet. Imposer une procédure qui limite sa capacité à choisir librement ses collaborateurs revient à nier cette réalité politique universelle. Dans de nombreux pays, les gouvernements sont formés avec des personnalités choisies par le chef de l’État, car ils sont censés porter sa politique et répondre de ses engagements.
Le projet de loi n°12/2025, en introduisant une liste restreinte de candidats et en limitant certains mandats à trois ans, crée une instabilité institutionnelle et affaiblit la cohérence du gouvernement. Le ministre de la Justice affirme que le pouvoir de nomination reste discrétionnaire, mais alors pourquoi instaurer une procédure qui contraint ce pouvoir et risque de le rendre inefficace?
Ce gouvernement, une fois mis en place, sera responsable devant le peuple. Et si les choix sont dictés par des mécanismes qui ne reflètent pas la volonté populaire, il en paiera le prix politique. Ignorer la majorité qui a porté le président au pouvoir, c’est non seulement une erreur stratégique, mais aussi une négligence démocratique.
Honorables députés, vous avez rendez-vous avec l’histoire. Soyez les garants de la souveraineté populaire, et non les artisans d’une technocratie déconnectée.
