Accused by his girlfriend of stealing his tuition fees: Louis ES sentenced to 2 years suspended sentence

Sylvia M. MB., 22, a Chadian student in her fourth year of medicine at Saint Christopher, brought her boyfriend Louis ES to court. She accuses him of stealing her tuition fees. Tried yesterday at the Dakar flagrante delicto court, the boy was sentenced to a two-year suspended sentence.

   

In her story, Sylvia explained that Louis ES is her boyfriend with whom she lived for a year. On Sunday, December 8, 2024, Louis visited her, around 9 p.m., in her apartment located in Fass Delorme. Sylvia said she informed him that she had received the sum of 1,450,000 CFA francs intended for her school fees and that she had to top up the amount to have 1,650,000 CFA francs. She withdrew the sum from the bank. On Wednesday, December 11, Louis ES returned to her apartment while she was in the shower. He went to settle into the bedroom. After her bath, Sylvia said she joined her boyfriend in the bedroom. They stayed together until midnight before the boy took his leave.

However, on December 17, when she wanted to pay for her school fees, Sylvia noticed that the money had disappeared. She informed her lover who said he was sorry about the situation.

However, on January 8, 2025, Sylvia still noticed a shortage of 30,000 CFA francs in her Wave account. This is how she contacted the money transfer service. The agent gave her the number to which the transfer was made. To her surprise, the contact was that of Louis ES.

Thus confused, the boy admitted to having transferred the 30,000 CFA francs that he promised to repay. But he denied having stolen the 1,650,000 CFA francs. However, she said, the same week, he bought a new cell phone, a pair of shoes, he went out to nightclubs and restaurants, while his financial resources do not allow him to do so. This change in behavior also aroused her suspicions.

Heard, Louis ES, 24 years old, Master student, declares that his girlfriend wrongly accuses him, regarding the 1,650,000 CFA francs. He stated that on the day of the alleged theft, December 11, he was with another girlfriend.

Maitre Alioune Badara Ndiaye, on behalf of the civil party, claimed the sum of 3,000,000 CFA francs in damages. The prosecutor requested the application of criminal law. Maitres Aboubacry Barro and Mor Samb of the defense pleaded for acquittal.

At the end of the trial, Louis ES was acquitted of theft. He was found guilty of fraudulently accessing and maintaining a computer data processing system. He was sentenced to 2 years suspended. He must award the sum of 200,000 CFA francs for all causes and damages combined.
