« Une loi 3 fois dangereuse » : Aïssata Tall Sall démonte les articles de la proposition de loi modifiant le code électoral
The debates on draft law no. 11/2026 amending the Electoral Code were marked by a particularly incisive intervention from MP Aïssata Tall Sall. The former minister strongly denounced a text she considers perilous for Senegalese democracy, structuring her criticism around three major pillars.
From the outset of her remarks, the parliamentarian challenged the very philosophy of the text. Recalling that a law must, by its very nature, be "general and impersonal," she argued that the current reform targets highly specific individual situations. She specifically pointed to adjustments to Article L.29 concerning the provisions for default judgments, which, in her analysis, reflect an underlying political intention far removed from the universal spirit of the law.
The lock of non-retroactivity
Aïssata Tall Sall particularly emphasized the issue of retroactivity, which she considers the most critical point of the text. She reiterated that the retroactivity of a law is a legal exception that must be strictly regulated. She therefore questioned the legitimacy of a mechanism that would seek to overturn final court decisions, seeing it as a direct attack on the authority of res judicata, whether at first instance, on appeal, or in the Court of Cassation.
A warning about the balance of power
The parliamentarian also raised a profound institutional criticism. Believing that certain provisions could be interpreted as a disavowal of judicial decisions by the legislative branch, she reminded everyone that the Constitution requires all citizens to respect the rulings issued by the courts. In her view, this blurring of lines weakens judicial authority in favor of a political agenda.
In conclusion, Aïssata Tall Sall emphasized that this reform carries within it the seeds of a personalization of the law and legal instability. By combining contested retroactivity and a weakening of the justice system, this text is, in her words, "dangerous for the Republic," urging her colleagues to consider the historical significance of their vote.
