Cité Touba Almadies : La Justice tranche en faveur de Cheikh Amar
In the dispute between the Association of Residents of the Cité Touba Almadies, led by Deguene Mbaye, and real estate developer Cheikh Amar, the courts have ruled in the latter's favor. The Dakar High Court, ruling in summary proceedings, dismissed the Association's claim, which accused Mr. Amar of land theft and failure to comply with contractual commitments under Ministerial Order No. 8673 of October 7, 2008.
The Association had taken legal action on February 13, 2025, requesting the suspension of any subdivision, alienation, or construction on public spaces planned in the initial plan for the Cité Touba Almadies (school, health center, mosque, Daara, gardens, public squares). It denounced an attempt at land speculation by Mr. Amar, in particular the alleged sale of the Daara land to a third party, Moustapha Diouf Lambaye, and cited risks of public order disturbances. The request, accompanied by a penalty payment of 5 million FCFA per day of delay, was based on a file including contracts, plans, and administrative appeals.
However, the court rejected the association's claims, finding that the evidence provided, including the ARTA receipt, the ministerial decree, and the initial plan, did not sufficiently establish the urgency or the alleged irregularities. This decision marks a significant victory for Papa Cheikh Amadou Amar, who thus maintains his position in this long-standing land dispute.
