Criminal prosecutions and TV signal cuts: Publishers denounce a threat to Senegalese press freedom

The Senegalese press is going through one of the darkest periods in its history. In less than 48 hours, several authoritarian decisions taken by the authorities have jeopardized the very existence of media companies, according to the Council of Press Publishers and Distributors of Senegal (CDEPS). In a public statement, the organization denounced a brutal attack on press freedom. "We have no choice but to fight to preserve our right to information. Press freedom is an essential pillar of any democracy," declared the CDEPS secretary general.

A major symbolic demonstration is planned for World Press Freedom Day on May 3. Efforts are also underway to mobilize civil society, human rights organizations, and the international community. The CDEPS calls on Senegalese citizens and all stakeholders in the country to demand an immediate end to these arbitrary practices and to guarantee a free, independent, and prosperous media environment.

According to Mamadou Ibra Kane, president of the CDEPS and signatory of the press release, Senegalese Television (TDS-SA) recently interrupted or seriously impaired the signal of fourteen local television channels, citing late payments. This decision was described as "brutal and unprecedented" by the CDEPS, which deplored the lack of notice and the inability of the channels concerned to assert their rights. In addition, several media outlets received firm injunctions ordering them to immediately cease broadcasting for reasons of "administrative non-compliance." The lack of "recognition" by administrative and political authorities now exposes media outlets to criminal prosecution, thus criminalizing an activity protected by the Constitution.

Flagrant violation of the law and precariousness of the sector

The CDEPS condemns these maneuvers, which run counter to the fundamental principles of separation of powers and independent media regulation, as enshrined in the Constitution and the Press Code. "Since the new government came to power in April 2024, the media sector has been subjected to unprecedented pressure," the organization further denounces, seeing this as a clear attempt to muzzle a sector already weakened by growing economic insecurity. These coercive measures compromise not only the independence of the media, but also their economic survival.

As a reminder, in September 2024, the CDEPS filed an appeal against the decree establishing the "Press Enterprise Review and Validation Commission." This controversial text, perceived as a tool of political control, never received a response from the judicial authorities. Worse still, other violations of the law continue to be noted, prompting the CDEPS to announce new appeals before the Supreme Court.

Faced with this critical situation, the CDEPS intends to react firmly. A series of actions is being prepared to alert national and international public opinion.

    La liberté de la presse commence par s'acquitter de ses devoirs en payant ses impôts et ses obligations en direction de TDS. Le signal qui vous permet de diffuser et gagner de l'argent à un cout. Dans la liste on retrouve les alimentaires dont le raccord est débranché.

    Payez vos obligations et Arrêtez de nous tympaniser . Pourquoi on laisserait des délinquants financiers de votre rang se sucrer sur le dos des sénégalais. C’est le seul secteur dont certains acteurs pensent pouvoir fouler au pied les lois et réglementations du pays et se permettre d’accuser à tout va les autorités…
